We specialise in defending clients against criminal prosecutions from the Environment Agency and other environmental (and health and safety) regulators. We advise on all aspects of defence of such prosecutions and usually provide the advocacy ourselves.
Our work on prosecutions has included successfully defending a number of waste companies, substantial petrochemicals companies, chemicals manufacturers, food sector companies and various others.

- advising a US chemicals company on its defence of the second largest prosecution for (fraudulent) breaches of a PPC consent, including full internal investigation of facts concerning incident, attendance at interviews under caution, as well as successful protection of information through litigation privilege
- advising international petrochemicals company on defence of environmental and health and safety claims arising from Buncefield incident
- advising a multinational petrochemicals company on defence of a number of criminal prosecutions and on a civil claim relating to the migration of hydrocarbons onto a development site
- advice to significant development contractor in relation to alleged failure to obtain appropriate waste management exemptions for a development site, including successful negotiation with the Environment Agency and avoidance of criminal prosecution
- advising nuclear licensed site operator on Crown Court prosecution by Environment Agency in respect of unauthorised discharges of radioactive material
- advising a waste company on appeals against enforcement action taken by the Environment Agency for breaches of the odour conditions in its PPC permit
- defending various other criminal prosecutions for companies from a wide range of sectors such as water companies, waste companies, large chemicals manufacturers, food companies, tools and furniture manufacturers, printing companies and farming clients, including civil claims arising from those prosecutions
