Insolvency and Banking
Burges Salmon’s Insolvency and Banking team advises banks on the taking and enforcement of security, including receiverships, as well as drafting charges over agricultural assets such as entitlements to the single farm payment.
We also act for borrowers in the rural sector, granting security and advising on bankruptcy, partnership administrations and other insolvency matters.
Our client portfolio includes HSBC Bank plc and Lloyds Bank plc (including the provision of their agricultural charge documentation). We also act for the Agricultural Mortgage Corporation and have advised Handelsbanken on their agricultural charge security.
We advise Rabobank on cross-border finance transactions in the Agribusiness and food sectors. For example we acted for Rabobank as lender to Westfalia on its acquisition of Greencell and have acted on a number of finance transactions relating to Thanet Earth, including acting for Rabobank Westland as lender to the Kaiij group.
